Keeping control of your affairs

Most people think that their spouse, child or close relative would have control of their affairs if they were suffering from dementia, a stroke or if they lost their mental capacity due to illness or accident. This is simply not true.

Unless you have made a legal document, called a Lasting Power of Attorney, the Government will take control of your affairs if you are unable to make your own decisions. The Government will appoint a Deputy on your behalf – someone you would not know. The Deputy would have the power to operate your bank accounts and investments and decide where you live.

Making a Lasting Power of Attorney allows you to appoint someone you trust, an Attorney, to make decisions for you if you are unable to make your own decisions. Your Attorney could be a family member or a friend for example.

Before your Lasting Power of Attorney can be used, it must be registered with the Office of the Public Guardian. The registration process takes several months. Your Attorneys will be unable to act until your Lasting Power of Attorney has been registered.
