Summary

A Lasting Power of Attorney is a legal document that enables you to appoint a person (called an ëAttorneyí) to make decisions on your behalf.† It allows you to appoint people you trust to look after your affairs.

It can be used should you become unable to make your own decisions.

There are 2 types of Lasting Powers of Attorney:

  1. Property and financial affairs
  2. Health and welfare

You can make one Lasting Power of Attorney or both.

Property and Financial Affairs Lasting Power of Attorney

You can choose one or more Attorneys to make decisions about your money and property such as:

  • pay your bills, household expenses, care fees etc.
  • claim and collect benefits
  • manage bank accounts
  • sell your home

Health and Welfare Lasting Power of Attorney

You can choose one or more Attorneys to make decisions about things such as:

  • what you eat and wear
  • your medical treatment and care
  • your permanent residence including moving into a care home
  • refusing life-sustaining treatment

You can put restrictions in your Lasting Power of Attorney to limit the things your Attorney can do.

Making a Lasting Power of Attorney

To make a Lasting Power of Attorney:

  1. Choose your Attorney (you can have more than one).
  2. Complete the necessary forms to make a Lasting Power of Attorney or speak to a specialist.
  3. Register your Lasting Power of Attorney with the Office of the Public Guardian.
